Why is Cerberus, one of the world's richest private equity firms, begging for a bailout?

When I wrote about the bailout blunders of the auto industry two weeks ago, I thought the Big Three had most likely topped out on the political outrage meter. But that was before the shady story of Cerberus, the uber-connected private equity firm that owns Chrysler, reared its three ugly heads over the weekend.

Buried on the business page of The New York Times Saturday were the details of Detroit's biggest snow job yet--literally as well as figuratively. Turns out that Cerberus CEO John Snow, who spent three-and-a-half lackluster, and some might say lap-doggish, years as President Bush's second Treasury secretary, is leading a who's who of crony capitalists in a lobbying campaign for a taxpayer bailout to "salvage Cerberus' investment in Chrysler."

That's right. Not to save the jobs of Chrysler employees or America's disappearing manufacturing base, mind you, but to prevent "one of the world's richest and most secretive private investment companies" from having to take a relatively modest financial hit and use some of its own capital to prop up the smallest of the major automakers. Anyone would think we had just elected a hip, skinny and youthful replacement for God, with a plan to modernise Heaven and Hell – or that at the very least John Lennon had come back from the dead.

The swooning frenzy over the choice of Barack Obama as President of the United States must be one of the most absurd waves of self-deception and swirling fantasy ever to sweep through an advanced civilisation. At least Mandela-worship – its nearest equivalent – is focused on a man who actually did something.

I really don’t see how the Obama devotees can ever in future mock the Moonies, the Scientologists or people who claim to have been abducted in flying saucers. This is a cult like the one which grew up around Princess Diana, bereft of reason and hostile to facts.

Dear Mr. Obama:

On October 24, 2008, a federal judge granted your request to dismiss a lawsuit by Citizen Philip Berg, who challenged your qualifications under the "Natural Born Citizen" clause of the U.S. Constitution to legally hold the office of President of the United States of America.

Mr. Berg presented factual evidence to the Court in support of his claim that you are either a citizen of your father's native Kenya by birth, or that you became a citizen of Indonesia, relinquishing your prior citizenship when you moved there with your mother in 1967.

In your response to the lawsuit, you neither denied Mr. Berg's claims nor submitted any evidence which would refute his assertions. Instead, you argued that the Court lacked the jurisdiction to determine the question of your legal eligibility because Mr. Berg lacked "standing."

Astonishingly, the judge agreed, simply saying, "[Mr. Berg] would have us derail the democratic process by invalidating a candidate for whom millions of people voted and underwent excessive vetting during what was one of the most hotly contested presidential primary [sic] in living memory."

Unfortunately, your response to the legal claim was clearly evasive and strikingly out of character, suggesting you may, in fact, lack a critical Constitutional qualification necessary to assume the Office of President: i.e., that you are not a "natural born" citizen of the United States or one who has relinquished his American citizenship.

Before you can exercise any of the powers of the United States, you must prove that you have fully satisfied each and every eligibility requirement that the Constitution mandates for any individual's exercise of those powers.

Regardless of the tactics chosen in defending yourself against the Berg lawsuit, significant questions regarding your legal capacity to hold this nation's highest office have been put forth publicly, and you have failed to directly refute them with documentary evidence that is routinely available to any bona fide, natural born U.S. Citizen.

As one who has ventured into the fray of public service of his own volition, seeking to possess the vast powers of the Office of President, it is not unreasonable to demand that you produce evidence of your citizenship to answer the questions and allay the concerns of the People. Indeed, as the one seeking the office, you are under a moral, legal, and fiduciary duty to proffer such evidence to establish your qualifications as explicitly mandated by Article II of the Constitution.

Should you proceed to assume the office of the President of the United States as anything but a bona fide natural born citizen of the United States that has not relinquished that citizenship, you would be inviting a national disaster, placing our Republic at great risk from untold consequences. For example:

* Neither the Electoral College on December 15, nor the House of Representatives on January 6 would be able to elect you, except as a poseur - a usurper;

* As a usurper, you would be unable to take the required "Oath or Affirmation" of office on January 20 without committing the crime of perjury or false swearing, for being ineligible for the Office of the President you cannot faithfully execute the Office of the President of the United States;

* Your every act in the usurped Office of the President would be a criminal offense as an act under color of law that would subject the People to the deprivation of their constitutional rights, and entitling you to no obedience whatsoever from the People;

* as a usurper acting in the guise of the President you could not function as the Commander in Chief of the Army and Navy and of the militia of the several states, as such forces would be under no legal obligation to remain obedient to you;

* No one in any civilian agency in the Executive Branch would be required to obey any of your proclamations, executive orders or directives, as such orders would be legally VOID;

* Your appointment of Ambassadors and Judges to the Supreme Court would be VOID ab initio (i.e., from the beginning), no matter what subsequent actions the Senate might take as well as rendering any such acts by such appointed officials void as well;

* Congress would not be able to pass any new laws because they would not be able to acquire the signature of a bona fide President, rendering all such legislation legally VOID;

* As a usurper, Congress would be unable to remove you from the Office of the President on Impeachment, inviting certain political chaos including a potential for armed conflicts within the General Government or among the States and the People to effect the removal of such a usurper.

As an attorney and sitting U.S. Senator, I'm sure you agree that our Constitution is the cornerstone of our system of governance. It is the very foundation of our system of Law and Order -- indeed, it is the supreme law of the land. I'm sure you also agree that its precise language was no accident and cannot be ignored if Individual, unalienable, natural Rights, Freedoms and Liberties are to be protected and preserved.

As our next potential President, you have a high-order obligation to the Constitution (and to those who have fought and died for our Freedom) that extends far beyond that of securing a majority of the votes of the Electoral College. No matter your promises of change and prosperity, your heartfelt intent or the widespread support you have garnered in seeking the highest Office of the Land, the integrity of the Republic and Rule of Law cannot, -- must not -- be put at risk, by allowing a constitutionally unqualified person to sit, as a usurper, in the Office of the President.

No matter the level of practical difficulty, embarrassment or disruption of the nation's business, we must -- above all -- honor and protect the Constitution and the divine, unalienable, Individual Rights it guarantees, including the Right to a President who is a natural born citizen of the United States of America that has not relinquished his American citizenship. Our nation has endured similar disruptions in the past, and will weather this crisis as well. Indeed, it is both yours and the People's mutual respect for, and commitment to, the Constitution and Rule of Law that insures the perpetuation of Liberty.

As a long time defender of my state and federal Constitutions, and in consideration of the lack of sufficient evidence needed to establish your credentials as President, I am compelled to lodge this Petition for Redress of Grievances and public challenge to you.

Make no mistake: This issue IS a Constitutional crisis. Although it will not be easy for you, your family or our Republic, you have it within your ability to halt this escalating crisis by either producing the certified documents establishing beyond question your qualifications to hold the Office of President, or by immediately withdrawing yourself from the Electoral College process.

With due respect, I hereby request that you deliver the following documents to Mr. Berg and myself at the National Press Club in Washington, DC at noon on Monday, November 17, 2008:

(a) a certified copy of your "vault" (original long version) birth certificate;
(b) certified copies of all reissued and sealed birth certificates in the names
Barack Hussein Obama, Barry Soetoro, Barry Obama, Barack Dunham
and Barry Dunham;
(c) a certified copy of your Certification of Citizenship;
(d) a certified copy of your Oath of Allegiance taken upon age of maturity;
(e) certified copies of your admission forms for Occidental College, Columbia
University and Harvard Law School; and
(f) certified copies of any court orders or legal documents changing your name
from Barry Soetoro.

In the alternative, in defense of the Constitution, and in honor of the Republic and that for which it stands, please announce before such time your withdrawal from the 2008 Presidential election process.

Update: Hawaii Birth Certificate Laws

What is the Deal on this Birth Certificate?

The constitution demands “natural born” so as to mitigate the possibility of “divided loyalties”.

Anyone can swear and sign the form to the registrar in Hawaii that they were a citizen of Hawaii and within the previous year gave birth. The individual gives the date/time of the birth and a document record is dually entered. Perhaps someone can inform as to whether you even need to show the baby! Doesn’t look like it from my read of the statute.

[§338-17.8] Certificates for children born out of State. (a) Upon application of an adult or the legal parents of a minor child, the director of health shall issue a birth certificate for such adult or minor, provided that proof has been submitted to the director of health that the legal parents of such individual while living without the Territory or State of Hawaii had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child.
(b) Proof of legal residency shall be submitted to the director of health in any manner that the director shall deem appropriate. The director of health may also adopt any rules pursuant to chapter 91 that he or she may deem necessary or proper to prevent fraudulent applications for birth certificates and to require any further information or proof of events necessary for completion of a birth certificate.
(c) The fee for each application for registration shall be established by rule adopted pursuant to chapter 91. [L 1982, c 182, §1]

One can get a “Certification of Live Birth” with minimal documentation and no eyewitnesses. The date of birth can be any date the person enters! This document can then be used to establish citizenship for the purpose of obtaining a passport, but its lack of physically identifying information found on the "Certification Of Live Birth" precludes it from being useful in proving "Natural Born" status. I guess Obama thinks enough folks are so ignorant that he can get into the Whitehouse before too many find out.

The normal “Birth Certificate” or "Certificate of Live Birth" often but not always contains uniquely identifying information, but always has testaments from eyewitness’s (doctor, nurse, orderly) and the specific location so that it is now verifiable and traceable. What Obama’s has displayed is NOT a Birth Certificate. Even if it is real here are some forensic experts who say the displayed cert has signs of tampering), it does not provide any kind of traceable proof. This is not the traceable-to-an-individual “Birth Certificate” most any other American would be able to show. Read full story...

Getting the 'Ayers Issue' Straight

If we move beyond the retort of being 8 years old at the time, and consider what we already know, there is plenty of disturbing evidence from Obama's own past about the Ayers relationship.

According to Rasmussen Reports public opinion polling, 50% of voters believe that the "Ayers issue" has hurt the McCain campaign. According to the report, 57% say it is not an important voting consideration. And finally, 59% of all voters believe Ayers will have hardly any or no influence over the policies of a potential Obama administration. These numbers particularly disturbing. And so let's get this "Ayers issue" straight.

Yes, William Ayers and wife Bernadine Dohrn were anti-American domestic terrorists who bombed US targets. And sure, both have remained insolent about their terrorist activities, proudly declaring no regrets and "we didn't do enough."

But set aside the 1960s terrorism for a moment. What is pertinent is that the terrorist-turned-educator transitioned from assailing America's buildings to assailing America from within them.

When the question of Obama's relationship with Ayers was raised in his April primary debate with Sen. Clinton, he dismissively responded with the now famous falsehood that Ayers was just "a guy who lives in my neighborhood." We know the Ayers-Obama relationship goes well beyond this. An Ayers-pattern has emerged; Obama is hiding something and therein lies the "Ayers issue."

Ayers is on the board of the Miranda International Center think tank in Venezuela. The group calls Ayers "the leader of the revolutionary and anti-imperialist group . . . [who has] developed courses around the urban reform of schools, problems of capitalist education, and investigation."

In a 2006 speech at the World Education Forum in Venezuela, Ayers said, "We share the belief that education is the motor-force of revolution . . . I look forward to seeing how he and all of you continue to overcome the failings of capitalist education."

Sol Stern observes that Ayers "still boasts about working full-time to bring down American capitalism . . . Ayers now works to indoctrinate America's future teachers in the revolutionary cause, urging them to pass on the lessons to their public school students." In the Ayers social justice model of teaching, "knowledge-based and politically neutral curriculum" is gone.

Ayers & Obama

1) In 1995 Obama kicked off his Illinois Senate run in the living room of Ayers. Also in attendance at this political coming-out party was Communist Party member Quentin Young. The obvious question: Did Ayers introduce and launch someone he did not know, someone not in accord with his own agenda?

2) The same year, Obama had been chosen by Ayers to be the first chairman of the Chicago Annenberg Challenge, a public school reform project co-founded by Ayers. We are once again faced with the question: Did Ayers hire someone he did not know, someone not in accord with his agenda?

Having reviewed the CAC Board of Directors meeting minutes, Stanley Kurtz concludes that it "clearly involves significant consultation between the board, headed by Obama, and the Collaborative, co-chaired by Ayers." The materials "show that Mr. Obama and Mr. Ayers worked as a team to advance the CAC agenda."

CAC received a $50 million matched grant which the two used to advance radical alternative education. Funding, however, did not go directly to schools but rather to "external partners" with whom the schools were required to affiliate, writes Stanley Kurtz. Many of the partners were radical community organization groups, ACORN among them.

Another such group, given over $1 million, happened to be Ayers's Small Schools Project, a radical alternative education project founded by Ayers and directed by Michael Klonsky, an Ayers friend and former chairman of the Communist Party (Marxist-Leninist).

CAC also funded a group called the South Shore African Village Collaborative, philosophically a "carbon-copy" of the worldview of Obama's Trinity United Church of Christ pastor, Jeremiah Wright. One goal, according to its grant application to the Annenberg Challenge: "Our children need to understand the historical context of our struggles for liberation from those forces that seek to destroy us."

3) Obama served with Ayers on the Board of Directors for The Woods Fund of Chicago. The Fund gave $75,000 to ACORN, $6,000 to Obama's church, and $60,000 to the Children and Family Justice Center founded and run by Dohrn, wife of Ayers. The Fund also gave $50,000 to the Ayers/Klonsky Small Schools Network.

In two separate grants, $75,000 was given to the Arab American Action Network, founded by well-known anti-Semitic spokesman for the PLO and Yasser Arafat Rashid Khalidi.

Ayers, Dohrn and Obama were in attendance at a 2003 AAAN farewell party for Khalidi who was leaving the University of Chicago for a position at Columbia University, reported the Los Angeles Times. The Times has a videotape of the dinner but refuses to release it to the public; apparently the tape is damaging to the Obama campaign.

The video tape is said to include tributes by Ayers and Obama. The Times reported that Obama gave Khalidi a "special tribute" as he reminisced about conversations "around Mona and Rashid's dinner table" that had been "consistent reminders to me of my own blind spots and my own biases."

With evidence mounting and his "a guy who lives in my neighborhood" no longer tenable, Obama admitted, "And so I have talked to [Ayers] about school reform issues." He most assuredly would have, and these "talks" would be far more than casual; they clearly would have been policy and agenda related.

The record - that is, the parts the public are allowed to see - shows the two comfortably working along side one another. Do they accomplish all of the above while having opposing agendas?

And this is the "Ayers issue."

1) First, it is an issue that goes to Obama's honesty and forthrightness with the American people. Why is he secretive about what he initially called a "flimsy" relationship? Why has he been gradually changing his story as the facts emerge?

2) Second, this goes to Obama's judgment. Obama did not work against a radical domestic terrorist who continues to have radical views, he worked along side him.

3) Third, it follows, this goes squarely to Obama's ideology itself. What in Obama drew the radical Ayers into alliance with him? And why was Obama so comfortable moving within his sphere and advancing his agenda?

The "Ayers issue" is not 1960s terrorism.

Either Republican Senator John McCain or Democratic Senator Barack Obama will have to make very important decisions on tax policy when he takes office in January 2009. First, the U.S. economy will be recovering from the financial crisis and is already predicted to grow less than its usual rate of 3.3 percent over the last 50 years.[1] Second, President George W. Bush's tax cuts will expire in 2011, and the President must decide how to extend or make permanent some of the tax cut provisions.

Senator McCain will make the Bush tax cuts permanent, with the exception of the estate tax. McCain credited the Bush tax cuts with helping the economy recover after the 2001 recession.

Senator Obama, on the other hand, will extend the Bush tax cuts only for those taxpayers who earn less than $250,000 a year—he has deemed the rest of the people "rich."

Obama's economic narrative of the mortgage crisis ignores the facts. He has put free-market capitalism at the root of the current mortgage industry debacle, denying the real history of government interference in that market.

On September 15, with banking giant Lehman Brothers filing for bankruptcy protection, Obama was given the opening to begin weaving his anti-capitalist storyline. And that he did. Artfully blurring the mortgage industry crisis with generalized tax policy, Obama declared,

"I certainly don't fault Senator McCain for these problems, but I do fault the economic philosophy he subscribes to. It's a philosophy we've had for the last eight years, one that says we should give more and more to those with the most and hope that prosperity trickles down to everyone else."
